I/WE UNDERSTAND THAT THERE ARE INHERENT RISKS INVOLVED WITH SAILING AND TAKING SAILING LESSONS, including but not limited to equipment failure, perils of the sea, acts of other participants, and adverse sea and weather conditions, and I/WE HEREBY ASSUME ALL SUCH RISKS.
I/WE UNDERSTAND THAT I/WE HAVE DUTY TO EXERCISE REASONABLE CARE FOR MY/OUR OWN SAFETY and I/WE AGREE TO DO SO.
As a BLUENOSE SAILING SCHOOL Student(s), I/we assert that I am/we are physically fit and able to take sailing lessons, and I/we will not hold BLUENOSE YACHT SALES/BLUENOSE SAILING SCHOOL or their employees, instructors, agents or other associated personnel responsible for bodily injury or losses as a result of ANY problems (medical, accidental or otherwise) which occur while taking sailing lessons with BLUENOSE SAILING SCHOOL or otherwise participating in any BLUENOSE SAILING SCHOOL activity.
I/we fully understand that any BLUENOSE SAILING SCHOOL vessel has limited medical facilities and that in the event of illness or injury, appropriate care may need to be summoned by radio, and treatment may be delayed until I/we can be transported to a proper medical facility. I/we agree in advance to these conditions.
BLUENOSE YACHT SALES/BLUENOSE SAILING SCHOOL have made no representations to me/us, implied or otherwise, that they or their crew can or will perform safe rescues or render first aid. In the event I/we show signs of distress or call for assistance, I/we will not hold BLUENOSE YACHT SALES/BLUENOSE SAILING SCHOOL responsible.
I/we agree to forever discharge and release BLUENOSE YACHT SALES/BLUENOSE SAILING SCHOOL, its instructors, employees and agents, the owner(s) of any BLUENOSE YACHT SALES/BLUENOSE SAILING SCHOOL vessel, and affiliates, from any and all responsibility or liability for any and all bodily injuries, damages, or losses. I/we agree NOT to make a claim against or sue any of the above parties for injuries, damages or losses, whether they arise or result from any NEGLIGENCE or other liability. I/we further specifically agree, on behalf of myself/ourselves, my/our heirs and assigns, to indemnify and hold harmless the released parties for any and all causes of action arising as a consequence of any incidents which might occur as a consequence of my/our participation in any activities with or involving the released parties.
Furthermore, I/we grant full permission to BLUENOSE SAILING SCHOOL to use any photographs, videotapes, or recordings of the activities of the School and to do so without compensation.
I/WE HAVE READ THIS AGREEMENT, UNDERSTAND IT, AND AGREE TO BE BOUND BY IT, FROM THE DATE OF SIGNATURES, FOREVER INTO THE FUTURE. THIS RELEASE AND WAIVER SHALL BE CONSTRUED UNDER THE LAWS OF THE STATE OF RHODE ISLAND.
